These Terms and Conditions ("Terms") govern your use of the website chittibabubiryani.in (the "Website") and any food orders you place with Chitti Babu Biryani ("we", "us", "our"), a restaurant business operating in Kukatpally, Hyderabad, Telangana, India. By browsing the Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website.

1. About us

Chitti Babu Biryani prepares and sells home-made style biryani and related food items for takeaway and delivery. You can reach us at info@chittibabubiryani.com or +91 96663 13134. Our full contact details are on the Contact Us page.

2. Eligibility

You must be at least 18 years old, or be using the Website under the supervision of a parent or guardian, to place an order. By ordering, you confirm that the information you provide is accurate and that you are authorised to use the payment method supplied.

3. Menu, prices and availability

• All prices are in Indian Rupees (INR) and include applicable GST unless stated otherwise. Delivery charges and packaging charges, where applicable, are shown before you confirm payment.
• Menu items, prices and availability may change without notice. If an item becomes unavailable after you order, we will contact you to offer a substitute or a refund for that item.
• Food photographs are for illustration. Portion presentation may vary slightly from images shown.
• In the event of an obvious pricing error, we reserve the right to cancel the order and refund you in full.

4. Placing an order

An order is placed when you complete checkout and payment on the Website or confirm an order with us by phone. We will send an order confirmation with an order number and confirmation time. The confirmation time is the reference point for the cancellation window described in our Refund & Cancellation Policy.

We may decline or cancel an order at our discretion, for example where we suspect fraud, cannot verify the delivery address, or the address is outside our delivery area. Any payment taken for a declined order is refunded in full.

5. Payment

Online payments are processed by a licensed third-party payment gateway. We do not store your card, UPI or bank details on our servers. By paying, you agree to the payment provider's terms. Cash on delivery, where offered, must be paid in full to the delivery partner at the time of delivery.

6. Cancellations and refunds

Because our food is cooked fresh to order, cancellations are accepted only within 10 minutes of order confirmation. Refund eligibility, exclusions and timelines are set out in full in our Refund & Cancellation Policy, which forms part of these Terms.

7. Delivery and takeaway

• We deliver to selected areas around Kukatpally, Hyderabad. Delivery availability is confirmed at checkout or by phone.
• A flat delivery charge of ₹50 applies to orders below ₹500. Orders of ₹500 or more qualify for free delivery. Full details are in our Shipping & Delivery Policy.
• Estimated delivery times are indicative. We are not liable for delays caused by traffic, weather, incorrect addresses or the customer being unreachable, provided the food is delivered in good condition.
• You must be available at the address and phone number provided. If delivery fails because you cannot be reached, the order is treated as fulfilled and is not refundable.
• Takeaway orders should be collected within 30 minutes of the ready time we give you. Food held longer may lose quality, for which we are not responsible.
• Orders placed through Swiggy, Zomato or other platforms are governed by those platforms' terms, not these Terms.

8. Food safety, allergens and consumption

• Our kitchen handles nuts, dairy, gluten, eggs, meat and other allergens. Cross-contact is possible. If you have an allergy, tell us before ordering and we will advise honestly, but we cannot guarantee an allergen-free meal.
• Biryani and cooked food are best consumed within 2 hours of delivery. Please refrigerate promptly if not eating straight away and reheat thoroughly. We are not responsible for food quality after this period or for improper storage.
• Report any quality concern within 30 minutes of delivery with a photo so we can act on it. See the refund process.

9. Your account and information

You are responsible for the accuracy of the name, address, phone number and email you provide. We use this information only to fulfil your order, contact you about it, and comply with legal requirements. We do not sell your personal information.

10. Acceptable use of the Website

You agree not to misuse the Website, including by placing fraudulent or hoax orders, attempting to interfere with its operation, scraping content, or submitting abusive messages through our contact form. We may block access for anyone who does so.

11. Intellectual property

The Chitti Babu Biryani name, logo, recipes, photographs and all Website content are owned by us or used under licence. You may not copy, reproduce or use them for commercial purposes without our written permission.

12. Third-party links

The Website may link to third-party services such as Google Maps, payment gateways and social media. We are not responsible for the content or practices of those services.

13. Limitation of liability

To the fullest extent permitted by law, our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these Terms limits your statutory rights as a consumer under the Consumer Protection Act, 2019 or other applicable Indian law.

14. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. The Terms in force when you place an order apply to that order.

15. Governing law and disputes

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana. We would always rather resolve a problem directly, so please contact us first and give us the chance to put it right.
